That sounds like an issue specific to the juvenile justice system, which is different. And if they are arrested but never convicted, that's an issue with policing or the evidence or the failure to secure a conviction. |
If someone is a serious flight risk, they shouldn't be released, unless there are other conditions that could secure their appearance (surrendering passport, ankle monitoring, etc.). But if you really don't trust that someone will show up to court, you hold them. |
