In our family's experience with MCPS, they tell you inaccurate information at the meeting, they dismiss your child despite your objections, then you have to take MCPS to Due Process which is expensive if you want your child equally represented by an attorney. The system is serious broken and children suffer the consequences.

No. But, the parent can pursue due process. It is a team decision and if the majority of the team agrees to changes, the parent's recourse is due process.

I am sorry this is happening to you and your child. My DC MCPS school was incredibly helpful. They wouldn't do their own eval as her grades were ok, but once I took a private evaluation, they immediately established 504 and were very accommodating.

Go for it. File suit. I wish I could. We just pay out of pocket for therapy, tutoring and may leave public school entirely.
I wish someone with expertise and big pockets would find every low income ADHD child in MCPS who is being neglected and file a class action law suit.

Not evaluating children because of passing grades was actually a violation of the Child Find requirement by MCPS. It's one of the ways they are discriminating against children with ADHD.

For anyone who has had this happen in the last 6 months, please file a complaint with the State of Maryland. MCPS should be investigated for these practices.

If you can't afford an attorney, filing a State Complaint or a Complaint with the Office of Civil Rights is just a matter of completing the paperwork. You can do it without an attorney.

PP, do you know if one can file a state complaint based solely on Sec 504? Or are state complaints only for IDEA/IEP related violations?

For what it's worth, OP, FCPS will fight 504s and IEPs for "just" adhd. We got an IEP but DC had aspergers/ADHD/anxiety but that put him on the autism spectrum. A counselor from his to-be high school showed up at the hearing to fight even that. If we had not been aggressive with our shrink, tester, and tutor showing up, we might not have received the IEP - even for aspergers. It's not right, but it's the way the school districts fight now.

PP, I am not OP, but someone similarly situated. I am so mad, I want to try to file to recover damages, can either of these processes be used to recover damages or compensation?

In your complaint, you can propose reimbursement for the expenses you paid as a remedy for damages.
