Um, even if apartment rent would be the same as the mortgage, he should sell the house and take the cash and get an apartment, obviously. Seems like a no brainer.
But then, your friend sounds like he has a mental illness. So no amount of facts about probate, wills, etc., is going to help. You're asking the wrong questions, seems to me. You should be googling, 'how to help a friend who is depresssed' or anxious, or whatever. |

If she died intestate, this is true - and if there are any other siblings, they would be entitled to a share as well. The house does not belong to him. Also, your friend is not required to pay the mortgage - the estate is. At the very least, if your friend is not going to contact an attorney, he should contact the mortgage company about what needs to be done. |
