Lawyer here who has some experience in this space. I would stay on but start job hunting in earnest. I personally don’t think they would fire you for asking, especially with the mat leave background… but Finding another job at your level could take awhile. Take a look at your employee manual (probably posted somewhere online in your co apps) and it will tell you the general parameters for severance. So why not keep the job cover and $ as long as you can? You may indeed be put on a PIP, and at that point you’ll have 60 or 90 days or whatever they choose. Just to ask the question… Do you have any desire to stay? Do you have a manager to discuss this with? Is anyone trying to help you improve? |
WTF. You cannot do this. Her severance agt will definitely make the $ contingent on her not having other work lined up, and the co will often call and check, and at least ask op for certification. |

Fact that you received a negative review while on mat leave although you had a good end of the year review. What was negative? What didn't say? Did you push back? Did you extend your mat leave by claiming FLMA with little notice? What happened DURING mat leave that was problematic that You mentioned? |
The written review was just the total opposite of reality, and when I pushed back they all but admitted it and agreed. All of a sudden they told me to disregard the negative review and start fresh. But I've been over it for a LONG TIME and was actually hoping I wouldn't have to come back after mat leave no matter what, but I didn't line up another job as easily as I thought. So I came back, and have been in this miserable middle ground where I am definitely being pushed out (I basically have zero scope of work), but for whatever reason it's taking forever. I want a PIP or a severance package so I can stop doing any work and focus on my next venture with a little breathing room financially speaking, and I know they give out packages a lot, so I want one if I can get one. To answer another question, no, ZERO part of me wants to stay or improve my performance. The work is so dull and the culture is miserable. |
| Then just leave. You don't enjoy the job and you really aren't doing much work or contributing. I'm in an HR leadership role in my org and I would not support an exit package for this. I'd be working with your manager on terminating you for under performance of your job. |

This. OP I think you are frozen but you don’t hold the cards here, they do, and the downside of inaction at this point - not actively looking for another job while you are currently employed - may come back to bite you. Play out the scenarios that seem likely here - #1 they decide to let you go at the end of the year and you don’t have a plan B. #2- you ask for a package and they say no and you have no plan B and likely they expedite your exit at that point. Don’t hold out for the ideal situation - they give you a package and you can use the time and $$$ then to find another job. Only ask for a package if you are willing to risk that they expedite firing you and you don’t have another job lined up. You already have a data point from your leave about how hard it was to find another job. Don’t make your situation worse by ending up without a job, no severance and looking in this crappy environment. I think you need to be strategic here and recognize how bad the labor market is right now. If you are already dialing it in use that time and energy right now to find something else. |
