Tax Question

For those knowledgeable in taxes, I need your help!

We have a part-time nanny work for us. But for her taxes, her attorney suggested we say she works for us full time (35 hours a week) at a reduced rate (it would be equivalent to what she makes working for us part-time at a higher rate). DH is hesitant to do this because he doesn't want to get caught that she is only working for us part-time. Is there anything to be concerned with or are his fears legitimate?

Could we get in trouble with the IRS, Immigration, or any of those places if we state that she is working for us full time even though she jsut works for us part-time?

Have her attorney draft a contract that employs her on call for 35 hours, but actually working only for some. This should meet her needs and you won't have to lie. She wants it so her attorney drafts it.
