Yes, it will sort out soon enough. The Fourth Circuit will be overruled and then FCPS will have no choice but to fall in line with the DOE position. They elevate trans kids over everyone else, but it won’t be in their DNA to openly defy a Supreme Court decision.


But in the process tax dollars that should go to educating FCPS students will be spent on outside counsel to fight a losing battle.


If they capitulated to the DOE position now, they could be sued for not following the Fourth Circuit precedent, and they'd also have to defend that case.

Their sympathies obviously are with the trans kids, not the girls who don't want biological males in their private spaces, but legally they are in a Catch-22 right now.


Stop pretending your bigotry is in defense of girls and women.

The 4th circuit ruled that under VA law which recognizes gender identity as a protected class that transgender people can use facilities appropriate for their identity.

The Department of Efucation is bound by federal law (Title IX) does not recognize gender identity as a protected class, it recognizes biological sex.

Thus the conflict at hand. The SC will need to step in and rule. That will potentially lead to changes to policies in the NOVA school districts and anger proponents on one side or the other.

None really at TJ most kids dress down on the days they have practice and go straight to practice and then home.

I do not know what is being withheld so far--but laying out what is being withheld is a smart move on feds part. Remember, there are other school systems involved with TJ and lots of companies and donors support TJ.
