Yes, it is national defense information. That is the term used in the Espionage Act. And you'll see the footnote on page 22 of the affidavit, which explains that NDI and classified information are not one in the same (although they often overlap), so all the screaming about "the President can declassify anything" is irrelevant to the legal issue.

The redacted portions of the affidavit make clear that DOJ was anticipating Trump's "it's all declassified" defense when they chose which criminal statutes to proceed under.

Well, one thing is clear. The Trump team was lying when they said this search was all a surprise. Trump's attorney wrote a letter to prosecutors and specifically asked that the letter be provided to any judge asked to approve a search warrant. And DOJ did just that and attached it. So the Trump team knew perfectly well that this was leading up to a search warrant.

Thanks for this and to everyone else who answered! Yes, the classification “issue” has always been a red herring since none of the crimes being investigated require the information to be classified for taking them to be a crime.

But maybe they just needed to get the documents back and clean up the mess. Maybe they aren’t going to prosecute. That would be a shame though.

OMG, no. There are already copies of all those documents sitting somewhere -- probably on Trump's burner phone. This is no cleaning this up. He has to go to jail for what he's done. So does anyone else who participated.

You’re right of course. Interested that they left reference to that Kash Patel interview unredacted. Pretty much laid out the plan in advance—they were going to use the documents.

The other thing interesting about that letter is that it doesn't claim that he declassified any of these documents. It says the president CAN declassify documents, but makes no claim he did. Just further shows that is an excuse they made up after the search.
