Due Process

AG Holder gave a speech extending the meaning of "due process". According to him, if the President and his advisors determine that someone is a threat to the country, then that determination constitutes due process that can legally justify a death penalty. Given the many examples of governments jailing and killing their opponents, this would appear to be risky as well as being on very shaky legal grounds. I am neither a lawyer nor a historian, so I may not fully understand either what Holder said or its implications. I would appreciate your reactions.

Crappy extension of the Patriot Act.

This is the American Exceptionalism I hate -- the attitude that we are the exception ot every rule and exempt from all laws, including our own.

This is why I'm disappointed in Obama. He signed the NDAA, which allows indefinite military detention of anyone they deem an enemy or terrorist with no due process. The Obama Administration has gone after more whistle-blowers than Bush. http://www.salon.com/2012/03/07/nsa_whistle_blower_obama_worse_than_bush/

I think his failure to actually break with politics as usual has really disappointed me and will make me reconsider another vote for him. He's gone back and forth on the patriot act, ultimately his administration uses it quite a bit. He criticized Bush's extension of powers but has utilized them similarly in military and foreign affairs.

Separately, we thought Guantanamo would be closed too.

I've been watching for editorial response to Holder's speech and finally found an editorial decrying it in today's Times:
