| Anyone know a case where this has happened? Under what circumstances? Have friends in a custody battle and she really does not seem to be a fit parent - I am somewhat biased as I am friends with Dad and have only known Mom since kids...... I know judges usually favor the Mom under most circumstances. Do different states favor differently? This couple is in DC......... |
| The favoring of mom is an old notion. |
|
It's pretty hard in DC for either parent to get full if one parent wants shared. DC is one of the most pro joint custody jurisdictions in the land. (Moms are still favored in some parts of the country, PP.)
How is she not fit? If you are comfortable elaborating even generally? |
| His ex was a drug addict. |
| If the ex is currently using, I bet the dad could get full custody with supervised visitation for the ex. If she's a former user and in some sort of NA type program, I think she'd be less likely to be cut out of the custody loop. |
So he used to mess with a druggy? Without using? Be careful the skeletons you unearth. |
|
OP,
I know two cases where the mothers were mentally ill. Very very sad. One has supervised visitation. The other I'm not sure, maybe one/two overnights a week or something like that. |
|
My cousin's wife asked to have the child Tuesday through Thursday only.
The judge laughed on her face and gave full custody to dad. |
Sorry, I missed the joke. Why did the judge laugh on her face and gave full custody to dad? |
I'm also missing the humor. |
Me too. Is it because the mom only wanted her own child two night a week? What were the other circumstances? |
Because the mom clearly wanted to have her weekends be child-free. |
| My brother-in-law has full custody of his three kids. It was after his ex was brought up on charges of child abuse. They had been with her full-time and my BIL was fighting for custody and one day, DCFS called and said you're getting the kids as the police are arresting her. So he got them and they are in the midst of the court case now. The ex also had a fourth child and that one was given to the child's father as well. |
Um, so? That's the arrangement favored by 75% of dads. Would the judge have laughed at the father and given full custody to the mother if things were reveresed? |
| I read this thread that, unless the mother is an active drug user or beats the children, she will at least get joint. Doesn't sound like much has changed in decades. |
