In a fix wrt attendance - please help

My daughter will be going to third grade this year.

We had to travel with daughter out of the country to take care of my father, he underwent brain surgery. Daughter won't be able to make it to first day of school, she will miss about first 6 days. I emailed the principal and they notified me that they cannot guarantee a space at current school due to high enrollment and because my daughter won't be there on the first day of school. This they said is per federal law. I searched on vdoe website to find the policy/law, but could not. Does anyone know about this ? Are there any exceptions to this law ? The school my daughter goes to has a very good rating. The bigger concern is how much it will impact her.

If anyone can provide any information on this, I'd truly appreciate it.

Did she attend 2nd grade at the same school? Is she currently enrolled at the school for 3rd grade?

Yes, she attended the same school from Kindergarten and is enrolled for 3rd grade here. We got a letter for teacher assignment as well.

I found this on the FCPS website (although I am not sure which public school system you are in):

"FCPS must withdraw any student from its enrollment who is absent from school for 15 consecutive days or more."

It appears to me that your daughter should be fine if she is only out for 6 days. It also appears to me that, should your family situation require it, you would simply need to re-enroll her upon your return.

I am sorry for your father and wish you and your family the very best. I cannot imagine what you must be going through.

Seems a bullying tactic, and not sure why. Can you email the eacher she was assigned to, and explain your daughter will be back, and to expect her? Tho--I supposed the school could reenroll her but put hr in a different class/teacher. Seems very strange.

Based on what I know, if the student is not there on the first day of school, they will withdraw the child from the enrollment. When he/she comes back later, they will re-enroll him/her. Technically, they can reassign the child to a different teacher. But if the school is your home school, they have to re-enroll him/her and assign her to a class. Re-enrollment is a very quick process, but it may help if you let the school know about your situation before you leave.

If this is a public school, I would think that they have to make space for her.

Is this your neighborhood school? Or is your child in a special school (language immersion / Montessori / other?)
What has your attendance been with the school historically? are you an active family?

There is no law that says your neighborhood school has to hold a spot if it is overenrolled and you are a no show. For example, if someone new moved into your neighborhood this summer and went to enroll their children but the school was already over capacity, they might be assigned to another school. If this is the situation in your neighborhood, the principal is applying the same guidelines across the board without giving any special treatment.

Can you ask to see a written copy of the law? I would.

Are you at your neighborhood school, or did you transfer to that school through one of the transfer options?

I agree with the PP, I would ask for them to point out exactly where this law is written.

If she is enrolled in public school, it seems to me they would have to make space for her even if that means you would have to re-enroll. I would also contact the teacher and let her know your family situation.

6 days is not that many to miss and it seems to me the school is possibly trying to see if your story is true or not. Which is a really crappy thing to do IMO.

So sorry you all are having to go through this especially when you already have your father to worry about.
