
My company is about to downsize bigtime. A lawyer in my office today asked me about my exact due date. Can they technically lay me off right now ? I think they can, just not while on FMLA leave right ?
Anyone know....want to know what to do if it happens since I wont have much time to think since I am on baby watch. |
They can't lay you off because of your pregnancy (or your leave, for that matter), but being pregnant and/or on leave doesn't protect you from a layoff. |
What size company do you work for?
Are they offering severance packages? My company had a restructuring while I was pregnant and I was let go. I threatened to file a lawsuit stating that it was pregnancy discrimination and negotiated a better offer. It is also my understanding that you can be let go while on FMLA in certain situations - for example - if your entire dept is let go. |
