Voting out any kindengartener would be reprehensible regardless of whether he has Asperger's. If the staff and administration don't want him in that class, they should just reassign him but having the kids essentially put him on trial and publicly ban him -- those are some cruel and cowardly adults.

BTW on another note this is why every democracy needs a Bill of Rights. There are some things that should not be left up to a vote, regardless of whether it's kids or adults doing the voting!
