He still committed several felonies. Even if he is innocent of the homicide charge, he stlll will have to deal with the following.
Illegal use of a firearm. Both IL and WI law says you need to be 18 to use a firearm. In IL you need to be 21 to own a gun.
Illegal transportation of a weapon across state lines for a illegal purpose, e.g. for a minor to use.

He is guilty of a misdemeanor of violating curfew. He was actually warned by a passing officer and told to evacuate the area and he did not.

He is being tried as an adult, so those felonies will be charged, prosecuted and if found guilty (not sure how he can be innocent of those) and sentenced for those. There will be even more civil unrest if he does not do some prison time.


Sounds like felony murder. Felony murder is a legal rule that expands the definition of murder to anyone involved in a certain felonies and someone else dies in the course of it. It doesn't matter whether the death was intentional or accidental—the defendant is liable for it. In death penalty states, people who weren't even the shooter have been put to death under the felony murder rule.

No one broke into anyone's home. The streets belong to the public. Violating curfew isn't a felony. I'm either arguing with a retard (also, see inability to master simple formatting) or a 12 year old. If I'm carrying a rifle down King Street tonight and some idiot attacks me with blunt instrument and I shoot and kill him I have committed no crime. Same with Kyle. He was only charged to appease the masses while all this percolates. No way does he see time.
