Also that only applies if you are doing it as a full accessory dwelling unit (separate kitchen and fully separate from the main home). You are allowed, without a permit, to rent your basement as a “room in the house.” If it has a kitchen though you need to be permitted.

So is this correct, you can rent out a room in your basement without any license/permit in Montgomery county, md?

That is roommate rule, not a separate apartment

Read the full post. If it’s a separate apartment it’s an accessory dwelling unit and needs a permit. If it doesn’t have a kitchen it’s not an ADU. Therefore this rule applies.

My other town did a one year amnesty program I thought was pure genius. You come forward pay a $20 fee and you rental becomes legal, illegal apartments, illegal rooming houses, basements rented. One time fee good forever. After one year period program shut and huge fine if caught.

The next year they reclassified every house as a commercial property and tripled their property taxes and lowered property taxes for actual single family homes.

So many basement renter haters on this thread

It's OK to have 10 people living upstairs, but as soon as you install a stove in your basement, it's the end of the world

DMV needs stronger zoning laws. My vacation home is in town with no on street parking unless on the lease or owner. They do not allow the tenant AND owner to both park on street. To get new permit have to turn in old permit. Tenant must come in person with lease and license and they install on car. So Parks and beach is resident only. Either tenant or Owner not both. Our boardwalk is resident only. We limit cars in driveway and limit garbage cans per house. We have a strict definition of family. Parents, spouse and kids. Got a boyfriend living with you. Nope. Brother living with you nope. And they changed laws on beach Or parks no fine or ticket it is criminal trespassing you will be arrested. Groupers houses they pull the certificate of occupancy so no one can live there.

I love it there. So peaceful. They also made entire town a no stopping or standing zone. Need to register for a guest pass to park. DMV is loose, you should see some towns

MoCo requires off street parking availability for an ADU or needing to be within 1 mile of a metro

This is pretty good. I hope FFXcounty would do something like this but they are already over populated.

The reason it is not allowed in a lot of NoVa counties is because of over population and an ADU would help make the SFH into multi-family without the zoning and taxes.

FFX county has relaxed the zoning laws on independent ADUs of 200 sqft on the property though.
