Is it a long process and is there an appeal?


Not at all! We filed our case in Fairfax County and I think the court date was 6 weeks after I filed it. On the day of your hearing, you go to the county courthouse, find which courtroom you've been assigned and have a seat. The bailiff does a roll call of all the cases for the day, noting which cases have only one party present. If it's the defendant that's present and not the plaintiff, the case is dismissed. If it's just the plaintiff, the judge gives you 5 minutes to explain your case and how you arrived at your damages. He then issues judgement. For those that have 2 parties present, free mediation is offered. If you chose to proceed, you wait to have your case called. When it's called, you each present your side, you tell the judge how your arrived at your damages and he issues judgement. Attorney's are not allowed to represent anyone. You can be an attorney and act on your own behalf but a company attorney can't represent the company you're suing.

I want to say you can pick up a copy of your judgement (it has to be recorded by the clerk) like 10 days after the judgment is issued. In our case, the idiots appealed (on what basis I have no idea. They were to cut and install a granite countertop but mismeasured and the sink hole when across to cabinets instead of being centered in one. Their only solution was for us to cut or move our cabinets. They refused to refund our deposit so we sued them for it. It took no time for the judge to find in our favor). On appeal, attorneys are allowed but in your case (as in ours), it's pretty cut and dry. I was contacted by their attorny who offered to settle for half the amount of the original judgment. I told him we were comfortable representing ourselves, sent him some photos (he hadn't seen them) and mentioned thaton appeal I was going to ask for more money since I'd neglected to include dremoval and disposal of the botched countertop. A day later,they called again asking where I wanted a check for the full amount sent to.

It's not hard at all as long as your organized. There are lots of internet sits out there that tell you how to do it and you can always callthe clerks office if you need help. You can also include the cost of filing the case in your judgmnet.

Thanks for the information. Does it work against you if don't file suit immediately (even though it is within the statute of limitations period)?
