So basically a student can sleep in a hotel or motel in a good school district on school nights to get around this “policy”? That could be cheaper than buying a house in the desired district or paying private school tuition.

Just google FCPS residency and you can read the rules.

From the Virginia Code: 22.1-264.1. Misdemeanor to make false statements as to school division or attendance zone residency; penalty. Any person who knowingly makes a false statement concerning the residency of a child, as determined by § 22.1-3, in a particular school division or school attendance zone, for the purposes of (i) avoiding the tuition charges authorized by § 22.1-5 or (ii) enrollment in a school outside the attendance zone in which the student resides, shall be guilty of a Class 4 misdemeanor and shall be liable to the school division in which the child was enrolled as a result of such false statements for tuition charges, pursuant to § 22.1-5, for the time the student was enrolled in such school division. |

As written, the form attempts to keep those living outside the County from claiming County residency. Thus, the reference to paying tuition. If a student resides anywhere in Fairfax County, they wouldn’t be required to pay tuition. If they live in MD or Prince William County, parents would have to pay.

But that just specifies that it is required to be in a fcps school. It does not specify pyramid or cluster or individual school zone. |
My point exactly. No one thought about County residents wanting to move from one school zone to another back when the schools were very similar. Now, with such disparity within the County, where one school is the “good” school and another nearby school is considered the “bad” school, people are trying to find any way they can to fight back against a school system that is unresponsive to their concerns. |
No, you’re a jerk because you whined about how FCPS has a policy, but not a rule and how it wasn’t really a law. But you did nothing to even see if it was in the Virginia Code. It took a 5 second Google search to see that residency verification IS in the VA Code. Then when presented with the Code that you were too lazy to look up, you couldn’t comprehend it and whined some more. There are two ways you can break the law: you can provide a false address because you’re actually living outside the school division and are avoiding tuition for out of county residents.(22.1-5) OR you can provide a false address outside the attendance area simply because you’re trying to get enrollment in a particular school. BOTH are Class 4 misdemeanors. If you break the law in the first scenario, you can be liable for back-paying the tuition you should have been charged while you were attending while living outside the county. |

It would be interesting to know if anyone has ever been prosecuted for claiming residency in another FCPS school zone, especially if someone owns property in multiple zones. |
