I also find it surprising that your attorney is having such an issue with respect to irregular income. While many people are W-2 wage earners there are certainly plenty of independent contractors and business owners that have fluctuating incomes. It's not exactly a novel legal issue to deal with.


The World Bank has guidelines in place for staff members' spouses that allow access to records and benefits, to prevent spousal abuse.

If you are divorced, they would be. If you married, your spouse has rights under WB rules and will have access to your records.

Yeah, all ex wives would like CS calculation based on some imaginary "potential earning" that he isn't currently earning but the judge is sure he as the potential to earn.

It's very confusing. I like the idea of using annual income. However, since he has already ended his 150 days for this fiscal year, he is trying to get a settlement where he only pays a small amount for the next few months since he says he will not have additional income. He also says he has proof that he cannot work neither at the WB nor outside due to the VISA. My lawyer thinks that if the lack of income is not his fault then there's nothing we can do. I continue to think that he's getting off the hook too easily here but perhaps I'm wrong. Next fiscal year starts in July and I want to make sure that we get what's fair next time around.

If he isn't getting renewed, he has to go home
Also, he shouldn't count on 150 days for future contracts - will likely be 120 - also if he has been a consultant for a few years now contract renewal might not happen.

You just use the income averaged over the year to determine the monthly income for child support calculations. It's really no different than a teacher working under a 180 day contract.

I second the PP who said this shouldn't be an issue for your attorney. It's pretty common to have fluctuating salaries.

Another WB staff here-

The US State Department has become more strict in the allocation and utilization of visas. We have consultants on our team who are not allowed to stagger their days but are required to utilize them more continually unless a very exceptional assignment would indicate otherwise.

There are also limitations going into effect so that the same number of days are not guaranteed each year. If the department requires that level of support, then a contract or term position should be created, even if for one year.

Also, worth reminding that fiscal year begins July 1.
