You shoild check with an attorney, as the fact pattern matters - type and level of violence (psychological v physical), degree of 3rd party documentation, and whether violence occured in front of children.

In general, violence against the spouse would justify a restraining order and special terms of how the child custody switch takes place so that the abused spouse can have no contact with the abuser. But, violence against the spouse wouldn't necessarily mean no custody for abuser as long as violence didn't involve kids.

Messed up, but that's our system.
