If you are severed from the compnay - they must pay you for any unused PTO. That is not negotiable.

They don't. Unless you're in California and a few other states. In this area (MD/DC/VA), state law allows the employer not to have to pay accrued vacation etc. When a co-worker left my firm, she had 2 weeks of vacation accrued, she tried to get them to pay for it but to no avail.

A lot of people think this is true because many employers do pay for unused pto when an employee leaves or is terminated. But in DC they are not required to do so. Many do because it is an attractive benefit to have, however, all they are required to do in DC is let you know what the policy is.

Anyone know what the rule is if the job is here (VA) but the company HQ is in New York? Do our rules or theirs apply? He's under the impression PTO will not be paid off, so has been taking half days here and there to use them before he loses them, but if NY has to pay out, I'd rather he save them so we have a cushion - albeit small - come the fall...
