Construction cones on highway:car damage

| I'm going through it now. A traffic cone was knocked over into the travel lane which damaged the front bumper of my new vehicle. My insurance company informed me I may be held liable for the damage however I explained to them the Virginia DOT is responsible for the safety of their work zone. One agent agreed with me and the other made it sound like they just wanted to secure that deductible without addressing the issue. I have a well known insurance company and I am still getting the feeling they aren't doing anything but collect my monthly payments. Make sure they are doing what they are getting paid for. |

| How do you know where the cones were from? Did they have the name of the state DOT or a construction company? Could they have fallen off a passing vehicle and not be connected to a nearby construction site? What can you prove? |
