We need to change the sex offender laws

Age of consent is just such a weird, arbitrary measure. I've known 16-year-olds who were sexually active and handled their affairs with maturity and intelligence, and I've known people in their twenties who were probably better off wearing a chastity belt (one could make the same point regarding voting or military service).

I don't know how to address this. The law is a blunt instrument, and I can't think of a way to finesse it for this issue. Puberty + a test? I don't think it would be practical or appropriate to allow kids to test for a "Sexing License"

Age of consent laws exist because we as a society through our legislators have decided that kids below a certain age do not have the capacity to make adult decisions. It is our way as a society of protecting our young people. There is a presumption that kids below a certain age do not have the experience and maturity to make certain decisions. So even if a 14 year old says that he or she is 17, we presume that that statement is due to immaturity and expect that legal adults bear the responsibility of ascertaining the actual age of a potential partner.

We could adjust our age of consent laws if we believe that today's kids are more mature than those in the past, but then we would have to come up with an age at which we think children should be protected. What would that then be: 15, 14, 13, younger?

These types of stories horrify me. I was 18 once. And I met a girl that was 14; we were equally inexperienced, and equally physically mature. I did not know she was 14; i knew she was pretty and smart. I only found out her age at the end of the evening -- after things had happened. Legally, I may have sexually assaulted her, I am not sure..depends on definitions. But, it never occurred to be at the time that I was doing anything remotely wrong. We were just hanging out, and making out. That night in 1982 could have completely changed my life.

I would not have my career/family had I been labeled a pervert then. Oh, and most 18 yo guys would have done the same thing I did.

At the end of the day, can we all agree that there is a fundamental problem with having sex with someone you don't know. This is why I recommend to my kids that sex is a no-no if you don't know them.

what about the teacher-student sex scandals? why is that the male teachers who preyed on teen-aged girls are locked away in prison whereas the female teacher who slept with teen-aged boys get significantly lesser sentences (e.g., probation but no time served)?

I'm the PP from the post above yours. I understand the reasoning behind the laws, but that doesn't make the line any less arbitrary. In a perfect world consent at an age below full, independent adulthood would be tied to demonstrated intelligence and emotional maturity. In the real world, I can think of no practical way such an approach could possibly work.

Our priority as a society is to protect children. A 19 year old is an adult and a 14 year old is a child. A 14 year old is incapable of giving legal consent. We protect children by making it illegal for adults to have sex with them because children cannot give consent.

I am completely for protecting children through age of consent laws.
