What's the minimum notice are we legally required to give our live-in housekeeper?

Our housekeeper has been as close to perfect as anyone could expect. My wife has suddenly decided we could get a live-out person, and make better use of that space, and doesn't want to wait out the 30 days. Could we get sued if our housekeeper gets a legal aid employment or tenant attorney?

Sorry your wife sucks, OP.

That said, I might be interested in hiring her.

Check landlord-tenant laws. That's where you could get in trouble. PP's suggestion of paying rent (agree with another poster that 2 months seems fair) makes sense.

OP, a smarter question would be how to get your wife out and keep the housekeeper.

Consult a lawyer. She is essentially a tenant, you definitely owe at least 30 days notice. It's not easy to evict people for no reason. Not to mention it would make you the asshole of the century to kick her out for no reason and with no notice.

How big of assholes are we legally allowed to be?

Seems like that's your question, OP. What happens when your wife wakes up one day and suddenly decides she can get a better husband than you?

30day notice

Where will she be able to rent with 2 months rent $ but no job?

I think the real question is: WTF is wrong with your wife? I say that as someone who has employed live-in domestic help over the years, so I understand the desire to sometimes have them out. But this is unnecessarily abrupt and harsh, unless you're not telling us the whole story.

Would she qualify for unemployment?

Give her 30 days to find an apartment. Offer to pay three months rent (seriously, if you have a live-in keeper this cost won't affect you at all). Hire her as the live out keeper. Anything less is pretty awful ... really bad karma.

I told you Dan, not to come on DCUM with your question and "your side of the story."

I really want her out of our house ASAP so you stop banging her in our bed!

As another person with 2 full time live-in employees I just want to say that your wife sounds absolutely ridiculous and I would seriously question her morals if she even mentioned doing such a thing.

What on earth is so difficult about giving someone 30 days? She's supposed to find a new job AND a new place to live in 10 days all because your wife wants to free up the room?

Why are you supporting this horrible woman's decision?

To your question:

If you kick out your tenant with 10 days notice, you will most definitely be sued and she will most definitely win. Be a decent person and think about what you would do if someone kicked you out with 10 days notice.
