OP, please don't resign. What do you gain? Tell them you will resign with 3 months severance - thank you very much! They are trying to scare you.
Get laid off or fired - if you quit, you cant get unemployment. Although I dont know offhand how many months you have to work to collect unemployment, but that's your golden egg! You can get paid and not work when you have the baby. Look at this as a blessing in a way.

if she's fired for cause, she won't get unemployment either. Then you have to deal with future interviews and explaining whey you were fired.
Resign on your own terms - ask for severance and a reference letter. If they say no, then let them know that you'll file an EEOC complaint. You don't need a lawyer right now. Anyway, no lawyer would do this on a contingency. I woudn't. |
Did you already resign?
Which state are you in? VA is a right to work state meanwhile DC and MD have steps prior to cutting jobs for whatever reason. Do NOT look for a lawyer on contingency- if you cannot negotiate for a severance package (which is your best outcome here), have an attny on an hourly basis do this for you. And pick an attny in your state- no matter if they can litigate in other states. After only working for 2.5 months and depending on which state you are working- the best you'll get is a severance package of 2-3 months (that's best case).
