Sure, we’re talking about wait times, but wasn’t all of that supposed to improve with DOGE? Why are we even having this conversation after months of Musk’s best and brightest getting down to business 24/7?

Here’s the thing— DOGE’s job advertisement is specifically looking for people to identify waste, fraud and abuse, not fix wait times (though yes, the E is for efficiency, but alas, it’s all so confusing, are they addressing efficiency or waste, fraud and abuse? Those boys are quite the multitaskers, aren’t they.)

SSA has been a cluster since inception. It’s the most convoluted and difficult set of rules and laws ever written.

The average citizen has to hire an attorney to deal with SSA. Like op, she’s definitely going to be paying back money unless she hires an attorney.

Why do US citizens need attorneys to deal with SSA?

What does your letter say? Why were you overpaid?

Overpayment usually occurs because you didn’t report something to SSA.

I think the point is to frustrate people so much they don’t even want to bother.

They don’t unless the case is complex or has minimal merit and the keep pursuing it. I am detailed to deal with a backlog of initial claims right now. Maybe 25-30% have an attorney. 95% of attorneys are worthless and are very large firms who operate on volume and do zero work. Their business plan is zero effort and taking a cut of the claims with merit, which is enough claims to make a decent living of you don’t have to pay staff to do their jobs (that these folks get a cut of the benefits pisses me off). In a given month I allow maybe 1/3 of initial claims. More probably have merit, but often people don’t followup. Not complicated things. Straightforward, please fill out this two page form about how often you have seizures and what triggers them things. You mail it twice and call once and zilch. Or this doctor doesn’t appear to exist, can you please chest the spelling of the name and the address. Again, you make 2-3 contact attempts and nothing. If those people get it together on appeal, some will be allowed.

There is almost no difference in the allowance rate at the initial and recon levels between people with attorneys and those without. And we do a lot of hand holding. But TBH less recently because we are so underwater. The attorneys who don’t work the claims? They also don’t screen them for merit.

Now, once you are looking at an ALJ hearing or the AC or District Court, a good attorney can help. But a claim with merit where the claimant cooperates and responds to agency requests shouldn’t get that far.

It’s more common in CDRs. The agency automatically reviews your claim every 3-7 years (how often depends on a number of factors). If they review and deem you not eligible, you have the choice of having benefits cease or continuing to get a check while you go through appeals, which the understanding that if you ultimately lose, you have to pay the agency back. Appeals take years. Obviously people stay on benefits. Not everyone is determined to still be eligible. Hence, overpayment.
