FAFSA and divorce

So many of these responses are wrong. Please consult actual FAFSA resources. It has nothing to do with taxes.

If you are going by custodial parent, you are doing it wrong. You might not get verified, but if you are:

According to The Higher Education Act of 1965 (sometimes abbreviated HEA), the repercussions of lying on the FAFSA can include hefty fines, loss of financial aid, and even jail time. The Higher Education Act allows for maximum penalties of:

Up to 5 years in prison
Fines of up to $20,000
Returning any financial aid already disbursed

I’m OP is this directed to me? I have primary physical custody- I’m not trying to cheat or lie I just didn’t understand if exH income would disqualify my child from aid

No, OP. There are some who are using custodial parent when filling out the forms. I wanted to let them know there can be repercussions.

Here is the info about who fills out the FAFSA. Most custodial parents are the ones providing the most support.

“If your parents are divorced, separated, or never married, and don’t live together, the parent who provided more financial support during the last 12 months is the contributor and must provide their information. If both parents provided an equal amount of financial support or if they don’t support you financially, the parent with the greater income and assets is the contributor and must provide their information.”

And, you're not following the FAFSA rules. Is not based on custodial parent anymore.

So if the parent who contributes more makes less, are they the parent who fills out the FAFSA?

This states only if both parents contribute equally that it then reverts to the parent who makes more.
