You can’t claim diminished value on a leased vehicle. Only the owner can, and that’s the leasing company. |
Yeah that’s not a police report. It’s just a form. Not saying that in a jerk way but doesn’t determine fault etc. but like I said, if a car is stationary it’s never at fault. |
| OP Here...So here's what I did. I have State Farm as well as one of the other posters...so I called my agent to discuss my options. Talking to my agent doesn't affect anything and my agents are awesome. I explained what happened and she assured me that my safe driving record would be protected and it wouldn't affect my insurance because I wasn't at fault. She then said I had 2 options and both were discussed in earlier posts so nothing surprising. 2. Call the other's insurer and deal with all that horse crap starting with his rental company. 1. File through my insurance and have State Farm deal with everything. The pros of 2...I don't have to contact anyone else. The cons: I have to pay a $500 deductible to the autobody shop but I will get it back eventually when State Farm collects it from the other insurer. For me it was an EASY decision to go with my insurer. #2. I asked my agent why anyone would choose #1 and they said...not everyone has an extra $500 to float until it gets reimbursed. She also said not everyone has the coverage I have, so she said....if she was in my situation, she'd so #2 as well. |
but it does and it can. My car was also hit in front of our house while we were sleeping! It went up and of course they just told us "it is going up everywhere" yeah right |

No I did NOT have to file a claim with my insurance company if I chose not to. I could have just contacted the other insurance company and worked with them to take care of everything. I chose not. I chose to file a claim with my insurance. Now they will contact the other insurer. |
