My insurance wouldn’t “total” my car with $15k+ of damage.

Well I do because the KBB value is still about $25k.
Pretty sure you would be whining over $25k too, just saying.

If accident was your fault, I'd just be glad it's being fixed at all. Not a good time to buy a new or used car.

But it wasn’t OPs fault.

Irrelevant that the bad guy hit you pulling out of a strip mall and you don't want to drive your kids around in a Humpty Dumpty Tahoe.

Omg this story again?

sue the other driver. If you're an attorney with litigation experience you can do it pro se. For anyone else, it make no sense because the attorneys fees will outstrip the damages

If you are an experienced attorney, you understand that an uninsured motorist is almost assuredly judgment proof.

I don't think your insurance company will pay out diminished value to you... worth a shot though.

In this case, I think it might be worth hiring an independent claims adjuster who will argue on your behalf.

I was hit at National Harbor several years ago. DH and I tend to go through cars quickly, so a “dirty” Carfax or auto check report would have hurt when it came time to trade in, or sell.

We had a diminished value assessment done by Reed Appraisers, which we presented to our insurer. I highly recommend using them:

You are going to have a hard time making a diminished value claim on a vehicle with over 100,000 no matter what condition the vehicle is in.

So you are saying the accident brought the value of the repaired vehicle to $0?

That makes no sense.
