This is not true at all- both drivers broke the law, OP by failing to yeild and the other driving by speeding. The other driver’s speed would absolutely be considered in figuring out comparative fault.


That is not correct. If you are crossing lanes, you are required to yield. The speed of others is irrelevant. You did not yield to the vehicle that was legally in their lane.


But the other driver was not legally driving in his lane…he was speeding

It’s irrelevant. That lane legally belongs to that driver, speeding or not. Anyone crossing lanes must yield to a vehicle already in that lane.

OP didn't see the oncoming car, because it was going too fast for the sight distance from the intersection. Do you understand what I'm trying to say?

However you describe it, it's a reason why I no longer take the chance of turning on a yellow light. Where I live it is totally common for people to speed up to get through a yellow light and you enter the intersection at your own peril.

If you are making a left turn without a turn arrow, you are allowed to pull out into the intersection and then complete the turn on red to clear the intersection. Two cars are not allowed to do this. Per VA law, if you enter the intersection prior to it turning green, you may turn to clear the intersection legally.

Steady amber indicates that a change is about to be made in the direction of the moving of traffic. In Virginia, they are all blinking yellow arrows now. No more left turn yield on green. So yellow doesn’t mean it’s about to turn red. And Virginia is a contributory negligence state, so the other driver’s behavior does matter.

+1 There was a family in Bethesda who had an actual death incident in a very similar scenario on River Road a few years ago.

Yeah OP you are at fault. There is no way that the car "suddenly appeared" even if they were speeding. You just didn't notice them or were being inattentive or thought that they would slow down and stop when they didn't.

You don't understand the concept of "sight distance". The speeding car suddenly appeared from around a curve.
