My ex husband is an alcoholic and I had to obtain a protective order for my three children after a serious event during his parenting time.
I need an attorney who can help me navigate this. The goal is my ex gets sober and gets healthy and resumes parenting time, but it’s also clear that some modification of custody is needed in the interim. I also want him to permanently surrender a gun he apparently purchased after our divorce but didn’t alert me to (it was seized by the Sheriff’s office when they served him the TPO). He’s stating this would violate his rights to own a gun. He’s hired an attorney who prides herself on being “aggressive”. While I want to keep things child centered and productive, I am seeking an attorney who isn’t intimidated by the uber aggressive style and will put the safety of the kids first. We’re in Montgomery County. Please share any recommendations. My former attorney is not up to the task - nice but clearly unwilling to stand up to the aggressive style of ex’s attorney. |

I don’t have a recommendation for your jurisdiction but as someone with a TPO and going through a divorce, I have separate attorneys for my TPO and my divorce case. They are at the same firm and communicate freely. I think you need someone with a civil law focus, not family law focus, and they can then check in with your former divorce attorney so that a parenting plan can be modified as needed based on the outcome of the TPO.
