Not OP but because that’s automatic reckless driving in Virginia and can be charged as a felony. Has happened to my DH and to my uncle. |

| Ok, OP -- no one can recommend a lawyer, which is what you asked for, until you tell us where this occurred. If it's VA, they need a VA lawyer, if MD, a MD lawyer, etc, and it sounds like this maybe even occurred outside of the DMV (your post isn't clear). |
OK so im a MD driver and its 30+ that is considered reckless. When I drive on 55 mph highways around here, 75 is pretty much common speed when traffic isnt too heavy. I always thought to be charged with reckless driving, you needed to drive reckless as in cutting people off, tailgating. Etc. Weird to think they will get you on that based on speed alone. |
No. So 20 over is automatic reckless driving in VA and like you pointed out 30 over in MD will be. I also know of someone who fell asleep at the wheel and crashed, and that was automatic reckless driving as well. |
Is VA actually enforcing this as written? Seems like it be nailing every day drivers just cruising along 95. |

Anything over 80 is reckless in VA too. Even if you’re in a 65 zone.
Having said that, in VA years ago I got stopped doing 82 in a 65. Had to show up To court. I took the driver improvement course ahead of time. All I got was a fine. I got 3 points as well but the driver improvement course was 5 “ good “ points so they didn’t go on my driving record. |
