Apparently these yokels in Michigan somehow bought shares of Musk's privately held stock days before a Pentagon contract became public? After being busted, the metro Detroit congresswoman goes on TV last night and says she's innocent because had they actually had the inside info, they would have bought 50 times more!

The Securities Acts of 1933 and 1934 apply only to publicly traded securities.

If they got information that other investors didn't get, that is a private matter.

+1 Yes, you can have insider trading for private stock. SEC's reach isn't limited to Nasdaq. It's just harder to enforce for private firms, because even though they deal in shares, public trades are easier to track via filings and market data.

So I worked for SAIC when they had company stock (before they went public). I don't think we were allowed to trade it with anyone outside the company. And I don't think you could cash out until you left the company, which is what I did. YMMV, I guess.
