2025 Change to Hemp Definition

In November 2025, P.L. 119-37 amended the definition of hemp under Title 7, Section 1639o, of the U.S. Code, changing the limit to a total THC concentration of less than 0.3% on a dry weight basis rather than only delta-9 THC. The Senate Appropriations Committee stated that the changes to the definition of hemp were made to prevent "the unregulated sale of intoxicating" hemp products in light of concerns surrounding the proliferation of hemp cannabinoid products. The new definition of hemp explicitly includes industrial hemp, which generally is hemp grown for non-cannabinoid purposes, while making a number of explicit exclusions, such as

seeds from a cannabis plant that exceed a total THC concentration of 0.3%,
intermediate hemp-derived products with more than 0.3% total THC concentration, and
final hemp-derived cannabinoid products containing more than 0.4 milligrams of THC per container.

The new hemp definition also excludes hemp-derived cannabinoid products that contain cannabinoids that are not capable of being naturally produced by the cannabis plant or are capable of being naturally produced and were synthesized or manufactured outside the plant. The new definition will take effect November 12, 2026. Additionally, the law requires FDA within 90 days of enactment to publish lists of naturally occurring cannabinoids, THC class cannabinoids, and all known cannabinoids that have similar effects as THC class cannabinoids. FDA is also to further define the term container.

what? i don't know anyone who buys their THC products anywhere besides a dispensary. i have no clue what you are referencing.

Maybe you live in a legal state where dispensary access is the norm but a high-profit industry sprung up around these "hemp-derived" products, and you can probably find them in your local grocery store.

That's why their manufacturers are up in arms against this new bill. This whole industry goes away unless something gets changed before... 2027, I think it is?

I’m at the point that if congress, the prez and in many cases the supreme court say do one thing, i’m doing the other. Especially if it relates to the sciences.

So, doesn’t affect me at all.

A lot of those goods were already federally illegal. Realistically, t's not going to change anything.

The whole thing is dumb, frankly. A pure ban just keeps them from imposing safety regulations (like childproof packaging and testing requirements) and denies tax revenue. They're just creating wild west situation.

I’ve never taken any of the delta-8 products, seemed too sketchy even if it was legal. It’s not like it’s hard to go get gummies made from real weed at an actual dispensary.

Yes, Maryland. If you live in DC or VA, we are just a short drive away. It's not a big deal.

I don't do well with weed, Delta-8 products are much more effective and gentle for me.

Delta-8 is no less addictive than other cannabinoids. If it's easier for you to use, it's probaby easier for you to develop a habit/addiction.
