House as a premarital asset if you get divorced?

Not planning on getting divorced but with all the divorce threads this makes me curious. If I’m married w/ kids and we live in a house that I already owned prior to meeting my partner, do I have to split or give up the house if we got divorced? There’s a mortgage, it gets paid from our joint account. I make the majority of the income. No prenup.

Whew. This will depend. Are you both on the deed? Most likely you will have to negotiate it with accrued equity from date of marriage getting split, and you keeping the value of the down payment. So for example, you could buy out his share of 1/2 post-marital equity.

If you exclusively are on the deed and mortgage is should be your house, however you probably need to pay him from the time of marriage till now 1/2 of the equity.

I’m the only one on the deed, we haven’t updated it since we met
