Spewing hateful anti-Gay rhetoric at a military funeral is really beyond the pale. But watch as the weird circle of bizzare logic twists back on itself as Justices Scalia, Roberts, et al. will make pigs fly and other sorts of nauseating inconsistencies will be sustained.

It'd be way cooler if there was a secret party chamber beneath the building at which secret 35th degree Masonic rituals were conducted, followed by meals of the finest food served on the bodies of the most supple 18-to-21 year olds, followed by festivities at which unspeakable acts of pleasure occurred.

I mean, if you're gonna have all that power, why not put it to good use?

The justices will undoubtedly support the 1st Amendment rights of the protesters. But, on the other hand, Obama can have them all arrested as enemy combatants and the same justices will support their detainment without charges or trial. Though, I will admit that there is some threat to the protesters' free speech rights. After all, they aren't a corporation.

I don't see this as a partisan case at all. Supreme Court justices show bias on a lot of things, but I don't see them throwing this case one way or the other due to the content.

I think this is going to be treated purely as a question of time place and manner restrictions, not fundamentally an issue of the content of the speech.

I bet Kagan has to recuse herself because she is likely entangled with this one based on her prior job.

Yes, I could see them correctly, avoiding content issue entirely here, however, time place and manner is clearly the issue. Do you really think they would allow this speech if it were not so explicitly anti-gay and pro-christian? If it was purely anti-war protest at a military funeral, would they allow it? Doubt it. Case wouldn't even get cert.

They would argue that they are using their omnipotence for good. And I'm pretty sure they don't even have genitals, so.
