law on gifted education

What is the law that mandated gifted education? We are in Virginia. Is the law specific to the state or is there a Federal law? (Presumably AAP is the answer to the law requiring gifted education for children who need it).

In Virginia, gifted education is mandated by state law, not a specific federal law. The key regulation is the Virginia Administrative Code, 8VAC20-40-10 through 8VAC20-40-70, which outlines the Regulations Governing Educational Services for Gifted Students.

Some courts/agencies have also ruled that "gifted" can be an individual/special need that gets 504/IEP protection.

Not in Virginia. There are other states that use IEPs for truely gifted kids, most of the kids in AAP would not qualify for a GT IEP.

However the Virginia law is written, Arlington's program meets the requirements and it is pretty much non-existant. AAP, for the problems that people have with it, is probably one of the strongest programs in Virginia.

The PP you are responding to appears to be attempting to distort the issue by referring to entirely unidentified “courts/agencies,”

- which could possibly refer to jurisdictions outside the Commonwealth of Virginia, and are entirely irrelevant to Virginia schools.
