FEC chair Sean Cooksey—a Trump appointee who’s one of six commissioners at the agency—questioned Harris getting Biden’s donations in an interview with NPR Monday and said he expects there to be legal challenges, including in federal court. Calling the situation “unprecedented” and “really complicated,” Cooksey classified Biden’s handoff to Harris as “giv[ing] his entire committee, the cash and all the assets, over to another person” and said the changeover is likely “gonna have to go through a process” at the FEC. Cooksey suggested to NPR that since filing a complaint with the FEC can be a slow process, he thinks “there’s going to be a lot of challenges in the courts as well.” It’s unclear if those challenges would be legally sound, however: Both Weiner and Chlopak told Forbes they didn’t believe challengers wouldn’t be able to go straight to federal court without taking any complaints to the FEC first. Chlopak noted litigants could challenge the FEC slow-walking any complaints in court if the agency hasn’t made any moves within 120 days of the complaint being filed, but even if a FEC complaint were filed this week, that deadline would still fall after Election Day.

The money is in her campaign fund, it's being spent. If the FEC ever does anything it won't be until after the election. Most likely outcome, a 3-3 vote, vote fails, no action taken. |
