Bought car a week ago. No delivery yet. Can I back out of contract?

I bought a car a week ago. Found out that I could not take it off the lot due to it needing a repair. Part came in and it was also broken. Still don’t have the part or the car. Does anyone have experience with this in Virginia? Can I cancel the contract since I haven’t taken possession?

Just have them give you similar make and model off the lot.

Technically, you had three days under VA law to change your mind. However, you never received the car. So I would turn to this provision if you want out of the deal:

A motor vehicle that contains a defect or condition that significantly impairs its safety, use, or market value could be a “lemon.” If you've purchased or leased such a vehicle in Virginia, you may be entitled to either a replacement vehicle or refund of your purchase price under the Virginia Motor Vehicle Warranty ...

UPDATE from OP: I went in and said that I wanted to cancel the contract because they have not delivered the car. They have not held up their end of the bargain. They canceled everything and I have all of my money back and an officially canceled contract in hand!

If it is a lemon then you have 3 days to return it in VA. Also, how do you own the car if you haven't taken the Delievery of the vehicle?
