My parent just died, and we must pay rent for 30 days after death. Is this industry standard? |
Yes because they cannot re-rent apt. Right away. Not fun, but there you are. Also time to empty apt.
So sorry about your loss. |
I'm sorry for your loss. When my mother passed earlier this year, I had already paid for that month's rent and was able to move out her things before the end of the month. They gave me a refund for the days the room was vacant. |
My mom was there, in Fairfax, but when she moved out they refunded a pro-rated amount for the remaining month's time. Maybe the policy changed.
The place I moved her to after that, kept all the rent for that month when she passed. |
OP here. My parent died mid June, and had paid for June. But while we can empty everything by the end of June, we will have to pay rent through mid July. So an additional half month of rent, while the apartment is vacant. And they can’t work on the apartment while we’re paying rent. So then they’ll have two weeks to get it ready, and maybe they can get a new renter by August. But we’ll be using it through mid July, because hey, we’re paying for it. |
What does your contract say? |
There is no more industry standard since for profit corporations and private equity aggressively entered the senior care market. It’s really tragic. It’s all about how much money they can earn.
I don’t get how they can charge the same price if your parents aren’t eating any meals or receiving any services there. Sorry you have to go through this. I would just move all their stuff out asap and tell their neighbors to contact you if the company starts remodeling before July 15. Maybe then you can make a claim for them to return a partial amount. |
And it takes time to clean out the apartment.
Things are moved out. Repairs/cleaning is done just like any other apartment move-out. The apartment needs to be re-rented. Op, this is not the detail to bring you down. |
If you vacate the apartment and they can re-rent it before your obligation is up they’ll have to refund your money. We broke a lease at one of these places and they had my moms apartment re-rented in six days. I only had to pay for those days. So get the stuff out asap and ask them to start trying to rent it out. |
That's odd. My grandmother was at a Brightview in Fairfax and passed away at a mid-month point this spring. We moved her stuff out before the end of the month and were refunded for several days. |
We had that too but only because my sibling refused to remove the stuff. |
You have not moved everything out. That’s the issue. |
Nope. I told them that we could have everything out by the end of June, and they said we will still owe rent through mid July. |
Did you read the agreement?!! |
You need to give 30 days notice, that’s standard. As soon as you vacate the apartment they can work to re-rent it. If they’re able too you’re off the hook. My moms place had her apartment rented within a few days even though we were on the hook. As soon as they rented it out again our responsibility stopped. So yes, you’re financially responsible for it for a month but you won’t necessarily need to pay the whole extra month if they can rent it out sooner. Get the stuff out asap and see if they can get it rented. For all you know they could have had it rented by now and you’d have gotten a refund instead of owing though mid-July. |
