Insurance for in-home caregiver?

I am seeking in-home care for my father after too many agencies either didn't have care available in their area or the person wasn't the right fit. I've done in-home care before and liked the idea of finding the right person on our own, but I became a bit nervous after the last caregiver fell on the way to my parent's house, needed surgery... It was a mess and while we helped with her medical bills, I shudder to think what would have happened if the fall (or something similar) happened in their home and the person sued.

For anyone who does private pay in-home, do you also have workman's comp or other insurance to protect against these things? I saw that the law in Maryland (where they reside) is that any amount paid to an in-home employee over $1,000 in a calendar year requires workman's comp. I'm assuming many people don't do this (and don't even know it is a law) but I'm curious how others have dealt with this.

Unfortunately, assisted living is not an option right now as neither wants to leave their home and there really isn't a medical need for them to right now. The care is more for companionship, meal prep, light housekeeping and my peace of mind.
