I am not a lawyer or a constitutional scholar, so I can't rebut the poster who is saying "that argument is fine but it's not in the law/the constitution". However there are many details that are not in the constitution. It depends on how one interprets the overarching principles expressed in it.
It seems to me that we have empowered the govt to regulate commerce. Such as workplace laws, and what is or is not part of health care. What drugs are approved and which are not. We have not empowered religion in any of those areas. So it's up to our government - our elected representatives - to reach a consensus about what medicines are considered standard and what are not. I'd be willing to bet the govt regulates certain minimum standards as to what a health care plan must offer. Birth control is no different. That's the medical consensus and the medical consensus - expert panels - is what the govt relies on. |

Employers of my religion should not be FORCED by the government to remove 8 year olds from factories and send them to school, because letting kids not work and go to school is against our religious beliefs. The federal government should not force us to do something with our kids that violates our religious beliefs.
