Is RICO an actual law you can break or a type of law?

AOC and I are both confused and we’re not lawyers. Legal minds, please help.

It’s a category.

The RICO Act comprises 35 separate offenses. A person must be convicted of at least two of those offenses in order to be found guilty of racketeering under the RICO act.

And now I’m asking Jeff to lock this because there are at least three other current threads discussing the hearing today.

RICO is whatever the politically motivated prosecutor says it is. And Dems are going to learn this works both directions pretty soon.

AOC was correct. RICO is a criminal conspiracy charge, so first you have to establish that specific crimes were committed before you can allege that they were committed by a criminal conspiracy. RICO is designed to charge the organized crime boss or kingpin for the crimes committed by lower level people.

It’s when you use a legitimate organization to conduct a pattern (at least 2) of criminal violations of specified criminal laws or (called predicate acts). So if you use your pillow company to conduct a wire fraud scheme. Or use a garbage collecting business to run an extortion protection money scheme. Or launder drug sales money through a pizza parkour. And there have to be multiple people involved.
