I have had intermittent FMLA last 2 years following my son's autoimmune diagnosis. Late last year I asked about changing to part time status. At the time we went through a very chaotic (at least from employee position) corporate merger which involved massive changes in HR stuff (through 3rd party companies and we haven't had a local HR person for 8 years now, besides we all went to remote starting with Covid and now they have closed the local office entirely besides offshoring 90% of staff). No information was available, my manager wasn't even able to find info who to contact to renew FMLA until the end of Jan although these changes were effective Jan 1).
In mid-January I asked for extended leave as the stress between helping my son (a lot of health insurance stuff and provider changes in particular) was more than I could handle. I'll have used roughly 7 weeks total of FMLA so by returning fulltime I would have 5 weeks worth left. But my son wants me to quit entirely. I will be 70 in June so will be taking SS then anyway. I have Medicare part A and am reading up on Medicare part B, etc. If I did change to part time status, say 24 hours a week, would the FMLA allowed be prorated based on my current hourly schedule (assuming it changed) or would it be based on my full time employment previously? |
