I'm nosy and looked up someone in the VA court database. They have a speeding ticket that was 24 mph over the speed limit (69/45) but it was only an "infraction" ticket that they were able to pay online and waive the court appearance. I thought speeding more than 20 mph over the limit was reckless and a misdemeanor? Is it just the police officer's discretion?

The date of the violation, and the date the ticket was paid, were less than 2 weeks apart, and Christmas and New Years were both in those two weeks. Would a court date in such a short amount of time be possible? The court date listed on the page isn't until February--but then under "Result" it says "Waived" and then when you scroll down you can see it was paid. |
It is it's lawless now. The amount of people I see run red lights EVERYDAY. The people driving around with no headlights at night in pouring down rain the last few days and no cops in sight. It's anything goes. |
| You got me curious OP, so I looked up fairfax county court records on speeding/reckless driving. Which one it is seems up to the officer. But almost all cases of 76-80 in 55 appear as speeding and almost all cases of 86+ in 55 appear as reckless |

It’s entirely luck as a lot rests with the discretion of the officer.
If you get written up as reckless, you can go to court and a judge can knock it down to just speeding. But much much better to have it just written by the officer as a speeding infraction to begin with. Never speed faster than 80 or more than 19 over in VA. |
