Disputing HOV violation on toll lanes?

Anybody have experience disputing an incorrect violation notice? I got a letter from EZPass Virginia saying I used the HOV transponder without three people in the car: that's incorrect, but if they couldn't see my kid in the back seat, how do I prove he was there?

I am pretty sure the burden of proving he was in the car is on the commonwealth and not you.

I assume they do, but they have not sent it to me. I just got a notice saying they would take (and they already have taken) the money out of my EZPass account.

They should have video and images of your car. I'd fight it.

On roadtrips, we have two young kids in the backseat in their car seats and occassionally my spouse sits in between them. So I'm alone in the front seat. When we go through the camera gate, I'll typically make a funny face and point to the back seat.

I've never received a ticket yet from the VA toll authority when using our HOV3+ transponder.

Thanks everybody. I disputed it yesterday and today they said I'd be refunded (in 7 to 10 days of course).

I assume a robot flags the photo, but I wonder if a human ever looks at it until you dispute. I'll make my kid wave next time!

I had 4 people in the car on express lanes, transponder in HOV mode and was charged. They checked the photo, saw there were 4 people but said I had to prove my transponder wasn’t working. 🤯My initial claim was denied. Ez pass department is different from express lanes department & they blamed each other. It’s very frustrating.

This happened to me on 66 as well, never had any issues on 495 express

That's so weird, I wonder if it accounts for a rear facing car seat.

Traffic camera violations are not legally binding as you cannot face your accuser in court, as the accuser is a machine.

Throw them in the trash where they belong.

I had the exact same experience. Very frustrating but I eventually got it dismissed.

I would vote for any governor promising to remove state enforcement of trans union debts . If they want to be a private company with a private asset, make them enforce contracts in court like any other private business
