We have a new director of special Ed services and at the IEP review we were just told that my child no longer qualifies for an aide and services are being rapidly phased out beginning immediately.
Is there a protocol for this because I don’t think the district is following it. I was expecting - and was fine with- a longer draw down periods with checks to make sure it’s going okay. |
| If it's in the IEP they can't just take it away. I think you have to agree. Don't sign the new IEP. Have another meeting to discuss gradual decrease. |
| I think you can refuse the new IEP and geg some kind of safe harbor. You may need an attorney to advise you how to invoke that and then what kind of due process to use. |
And there are deadlines. But it sounds like even you don’t think it’s necessary. So maybe figure out what you really want (very objectively and quantifiably) and how to justify it, then Ask for that. |

What state / county are you in? There are different guidelines and people will need to know in order to advise you.
In general - remember that needs drive everything else. What is your child's needs for a 1:1 aid? Was it behavior? Physical? The 1st part of the IEP is the present levels of performance - so these needs to be information in there that spells out how your child can not engage in the classroom successfully without the 1:1. |
