Claiming compensation from at-fault driver

If a car is deemed total loss due to negligence of another driver who hit it, the insurance company gives the fair market value for the car. However, replacing the car with a used car of the same model/year/mileage is still more expensive than the insurance settlement. How can I get the at-fault driver to pay for the difference?

Your best option moving forward would be to re-negotiate your settlement amount from your insurance company.

What’s the general flexibility on negotiating the settlement amount? Would insurance pay for the current retail value of the same model/year? Also, do they include golfers and taxes in the settlement?

If you find a comparable vehicle to the one that was totaled (same year, make, model, trim package) that sold for more than you’re being offered you can share that with your insurer. They may offer more. But you have to do the work and they’ll still end your rental.

Yes, their offer typically includes the price of a comparable vehicle in your area, taxes and fees. We've been hit twice and both times had some success in fighting the insurance company for a better offer.

I don't fully understand the business but they seem to really really really want to "total" your car and send you a check.

you issue is w/ insurance, provide them the information that shows you are owed more

That's why we have a system with car insurance so people don't have to sort it between themselves and aggressive parties don't try to get to pay out of their liking.
