Is this covered, drain leak?

Don’t know where to put this question. Bought house in June, kid took bath and water leaked on floor below. Told kid not to over flow tub. It’s been almost a year and each subsequent bath (3 told) it’s done the same. The culprit appears to be the overflow drain. Tonight is last test to determine if it is the regular drain but we shower daily and it doesn’t leak.
Is this my damage to have and to hold or is this a homes ins claim?

Have you had a plumber investigate? Are the baths being drawn so that when your kid is in the bathtub the water goes up to the overflow drain? That connection at the tub could be faulty (there is usually a rubber gasket to keep bulk water from leaking around the pipe, but it's not designed for continuous submersion). The pipe might be damaged. A few likely culprits. It's unlikely a huge fix and probably not covered as an insurance claim

Unless it absolutely necessary, don’t file home insurance. Don’t even call them to ask. It will be on the record and it will work against you.

This checks. Embarrassed to say I did this to my family growing up. Discovered I could twist the overflow drain so that it was pointing up. Then went about taking baths with an extra 3" of water, until the day there was running out the ceiling bellow.
