They are civil not criminal charges so don’t involve prison sentences. It’s a disclosure violation and not the sort of violation that would generally lead to a criminal indictment.

+1 And so many influencers have been fined for the same behavior. I think Kim’s sisters have even been fined.

That said, it’s these requirements have been around long enough. No one should still be messing this up. #ad #paidpartner isn’t hard to add to the long list of hashtags.

No but for this specific ad they also have to include how much they're paid to promote it. Which is NOT the case for regular sponsored content.
