| I was pulling out of a parking spot when the car beside me opened their door. My insurance company did not find me at fault and denied their claim. I got served today for $25,000 for damages. What can I expect? My insurance company will hire a lawyer to represent me in court. Anyone been in this situation before? |

Your insurance company and the attorney representing you both will take care of it. You may be deposed at some point, a proceeding in which opposing counsel will ask you questions about what happened. You'll have your insurance company's counsel present to guide you and to prepare you beforehand.
Chances are very good that this is a so-called nuisance suit, where the other side has no expectation of actually going to trial, but is anticipating that your insurance company will settle for some sum of money just to make the suit go away and to avoid the risk, however small, of losing at trial. |
| If counter sue |
| What state are you in? Court? GTFO. |
Ha, WHAT? Your insurance company and their lawyers will hand these scammers their ass in court. |
| Did you look around before pulling out? |
| Your insurance handles everything |
| Your insurance handles everything. Something similar happened to me in a parking lot in Alexandria. |
| My only comment to you would be not to say anything more to anyone other than the attorneys representing you. |
? the other person can still try to sue you, regardless of what determination the insurance companies make. |
me too. It went to arbitration between the two insurance companies and the other guy was found to have not been in control of his vehicle. But I don't think that necessarily stops him from trying to file a lawsuit. |
| Op here. Thanks all. It was unnerving being served yesterday for something that was not my fault. |
But then I would have to get my own lawyer |
+1. Don't answer anyones questions about this other than your own insurance. Don't even say that you were not at fault. Just say that you have nothing to say now that it's in the insurance company's hands. |
How would that have helped avoid this situation? It's not like there's any external sign that someone in a neighboring car is preparing to open a door... Sorry you are dealing with this, OP. |
