Is RICA nonpublic?

I know there is some gray area on how to classify RICA. My question is in regards to House Bill 1255 which bans seclusion in Maryland at public schools but not at non-publics, does it apply to RICA?

I think it is an MCPS public school and will need to follow the new law, but it doesn’t start until July. I could be wrong, though.

My kid is at RICA and I haven’t heard about anything changing with seclusion. It’s actually one of the reasons I fought for RICA. My kid needs the seclusion in order to re-regulate or de-escalate.

Admission to RICA is done by the medical team, not MCPS. MCPS provides the education but it’s non public.

RICA is a MCPS school and requires a CIEP. Unlike other nonmainstream programs, RICA provides medical services. I’m not positive but I think the medical and therapy are provided by the county.

I don’t know if the new law will apply to RICA but i can see reasons why it won’t given that it’s medical.
